I don't think it counts for Cameras. With them there is evidence of an offence, and ultimately even though no harm is done, a law has been broken.

Malicious Prosecution refers more to the (alleged) bahaviour of companies like Microsoft who will sue a smaller competetor, knowing full well that the company will not be able to afford the legal fees and will either settle out of court (in Microsoft's favour) or just go bankrupt trying to fight it.

And Google will also correct any spelling errors (see "malicious" - maliceious???), so you can't go wrong!
